Terms of Use — BioGyro

1. Acceptance of Terms

By downloading, installing, or using the BioGyro mobile application (the "App") operated by Gamble Systems ("we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

2. Description of Service

BioGyro is a personal nutrition tracking and metabolic insight application. The App allows you to:

Log meals by photo for AI-based food recognition and nutritional analysis
Track symptoms, energy levels, and digestive health through check-ins
Receive personalized insights based on your logged data via the Human Stability Index (HSI)
Access pattern analysis, weekly digests, and dietary guidance

3. Not Medical Advice

BioGyro is not a medical device and does not provide medical advice. The insights, scores, and recommendations generated by the App are informational only and are not intended to diagnose, treat, cure, or prevent any disease or condition. Always consult a qualified healthcare professional before making changes to your diet or health regimen.

4. Account Registration

To use the App, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your password and account
Accept responsibility for all activity under your account
Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent.

5. Subscriptions and Billing

Free Tier

BioGyro offers a free tier with limited daily usage (photo uploads, AI analyses, chat messages, and menu scans).

Paid Subscriptions

Paid subscriptions (e.g., BioGyro Standard) are available as auto-renewing monthly subscriptions through the Apple App Store. By subscribing, you agree to the following:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
You can manage and cancel subscriptions in your Apple ID account settings

Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the advertised price.

Refunds

Refunds are handled by Apple in accordance with their refund policies. We do not process refunds directly.

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Upload content that is offensive, harmful, or violates the rights of others
Attempt to reverse-engineer, decompile, or disassemble the App
Interfere with or disrupt the App's servers or systems
Use automated systems (bots, scrapers) to access the App
Share your account credentials with others

7. Intellectual Property

The App, including its design, code, algorithms, content, and the Human Stability Index methodology, is the intellectual property of Gamble Systems. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of the content you upload (meal photos, check-in data). By uploading content, you grant us a limited license to process it for the purpose of providing the App's services.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

9. Account Deletion

You may delete your account at any time from within the App (Profile → Delete Account). Upon deletion:

All personal data, meal logs, photos, check-ins, and insights will be permanently deleted within 30 days
Any active subscription must be canceled separately through the Apple App Store
Deletion is irreversible

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

The App will be available at all times or free from errors
AI-generated food recognition or nutritional estimates will be accurate
Insights or recommendations will be suitable for your individual health needs

11. Limitation of Liability

To the maximum extent permitted by law, Gamble Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, health outcomes, or reliance on App-generated insights.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in behavior that is harmful to other users or the service.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.
